Playing an important role of the litigation of traffic crash, the expert witness makes the<\/p>\n
reconstruction and the determination of the responsibilities. The persons who involving the crash<\/p>\n
could participate and represent opinions, relating the crash occurrence and causes, at the<\/p>\n
investigation committee meeting. They have legal right to infer the facts through the evidences in<\/p>\n
the dialectical process, moreover, there is no expert witness inferring. The paper introduces the<\/p>\n
professional negligence assault, caused by the truck rear-end collision between the motorcycle and<\/p>\n
truck. The motorcyclist who have got serious hurt and disability after the tragedy, initiated the case<\/p>\n
for satisfaction compensation. No expert witness was provided during the judicial litigation. The<\/p>\n
victims research the accident evidence by themselves. The accused appointed four defence<\/p>\n
solicitors in sequence to represent the accused in court. They supplied more evidence and debated<\/p>\n
with the occurrence and causes of th e crash. Through the criminal county court and the supreme,<\/p>\n
and the civil court, the motorcyclist obtained seven millions compensation, while she made<\/p>\n
reconciliation and withdraw a lawsuit. It is took a long time about two years and ten months. There<\/p>\n
is no similar report and available literature now. This paper focuses on the representation and<\/p>\n
deduction of the evidence in this case, defense and justice arguments in the jury, and makes<\/p>\n
readers aware of evidence of judicial proceedings and the accident reconstruction.<\/p>\n
